Heavy metal band and Warner Bros. facing major contract dispute

It is not uncommon for relationships between music artists and record label companies to become tenuous after extended periods of time. Situations change and other career opportunities arise that may not mesh with a current alliance between an artist or band and a record label company. Avenged Sevenfold, a heavy metal band in California, is actually engaged in this type of contract dispute with Warner Bros.

The band has apparently walked away from its recording agreement with Warner Bros., thus causing the contract dispute to erupt. In fact, it has released an album in conjunction with a new partnership with Warner Bros. competitor, Capitol Records. The heavy metal artists stated they believe they were acting in accordance with an 1872 state law that limits the enforceable length of contracts between actors and movie studios.

Although there is, in fact, a law in place that declares this, a provision was granted to record label companies in 1989, allowing them to file legal claims against music artists who leave contracts without having fulfilled required amounts of albums as per their agreements. Warner Bros. says Avenged Sevenfold still owes it one more album. The company has decided to pursue the matter through formal litigation.

Warner Bros. allegedly plans to cite the monetary success of the band's new album at Capitol Records as evidence of damages it has suffered, since technically that album should have been produced under its own label. An attorney representing the heavy metal band counters that any marketing efforts of Warner Bros. would not be able to generate as much income from the album.
